Usage Rights: What Models Need to Know Before Signing

Usage rights determine what a client can do with your images after the shoot: where they appear, for how long, and in what parts of the world.

For models, usage rights are the difference between a fair deal and accidentally giving a brand your face forever. They matter more than the day rate, because the day ends and the usage doesn't.

Three concepts cover almost everything: term, territory, and media. Learn them and you can read any usage clause.

Usage Rights: The Three Dimensions

Term is how long the client can use the images. Common terms run from a few months to a few years. "In perpetuity" means forever, and forever should cost a lot more than one year.

Territory is where. One country, a region, or worldwide. A local boutique needs local usage. A global brand asking for worldwide rights is asking for something far more valuable.

Media is where the images can appear: website, social, email, print, packaging, out-of-home billboards, broadcast. "All media" grants everything, including formats that don't exist yet.

Every usage clause is some combination of these three. The broader each dimension, the more the client is buying, and the more the fee should reflect it.

Why Broad Usage Can Cost You Future Work

The obvious issue with broad usage is undercharging. The less obvious one is conflicts.

If a skincare brand holds perpetual worldwide rights to your face, competing skincare brands may not book you. Your image is "attached" to their competitor indefinitely.

Watch especially for:

  • Perpetual or unlimited terms at flat rates
  • "All media, worldwide, in perpetuity" bundled into a modest day rate
  • Exclusivity clauses that block you from entire product categories
  • Rights to alter, composite, or reuse images in unrelated campaigns

Exclusivity is legitimate when it's paid for. It's a problem when it rides along silently in boilerplate.

"The day rate pays for your Tuesday. The usage clause decides what happens to your face for the next five years. Read the clause."

Questions to Ask Before Every Booking

Get answers in writing before you agree to a rate:

  • How long will the images be used?
  • In which territories?
  • In which media, specifically?
  • Is this a buyout, and what exactly does it include?
  • Is there any exclusivity, and is it priced separately?
  • Can usage be renewed, and at what fee?

Where Usage Rights Live in the Paperwork

Usage terms appear in two documents: the booking agreement or contract, and the release you sign at the shoot.

Danger lives in the mismatch. A casting might say "one year web usage" while the release you're handed on set says "all media in perpetuity." The signed release usually wins.
